LAVIA — Terms of Service

Welcome to LAVIA. By downloading or using the app you agree to these Terms. If you do not agree, please do not use LAVIA.

LAVIA is operated by the team at support@laviafit.app. When we say "we", "us", or "LAVIA", we mean the operator.

1. Who can use LAVIA

• You must be at least 18 years old.
• You must be capable of doing physical exercise safely. If you have any medical condition, injury, pregnancy, or concern, consult a qualified healthcare professional before starting.
• One account per person.

2. Accounts

You are responsible for keeping your login credentials secure. Notify us immediately at support@laviafit.app if you suspect unauthorised access. You are responsible for activity on your account.

You may delete your account at any time from within the app (Profile → Delete account). Deletion is immediate and irreversible.

3. Subscription & billing

LAVIA offers a free tier (limited workouts and recipes) and a Premium plan (personalised plan, full workout and recipe libraries, Face Yoga, advanced tracking, all challenges).

• Free trial: available on some plans, one per Apple ID / Google account. Full Premium features during trial.
• Premium: billed monthly or yearly, in local currency, via App Store or Google Play.
• Renewal: subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the renewal date.
• Cancellation: manage or cancel through your App Store or Google Play subscription settings — we cannot cancel on your behalf.
• Refunds: governed by Apple's and Google's refund policies. We do not process refunds directly.

Prices may change. If we change prices for renewals, we will notify you in advance and you may cancel before the change takes effect.

4. Nature of the service — not medical advice

LAVIA provides fitness content, guided workouts, Face Yoga sessions, recipes, and tracking tools. LAVIA is not a medical service and does not provide medical advice, diagnosis, or treatment.

You understand and agree that:

• Any exercise carries risk. You perform workouts at your own risk.
• Nutrition information is guidance, not medical prescription.
• Face Yoga is movement and relaxation; it is not a treatment for any condition and does not guarantee any physical, aesthetic, or medical outcome.
• Postpartum, perimenopause, or injury-related content is general information only. You must consult a healthcare professional before starting.
• If you feel pain, dizziness, chest discomfort, or any concerning symptom, stop immediately and seek medical help.

Consult a physician before beginning any exercise program.

5. Content

Workout videos, Face Yoga sessions, recipes, and text content are provided for personal, non-commercial use. You may follow along, take notes, and share your progress with friends. You may not:

• Sell, rebroadcast, republish, or use the content commercially.
• Extract, decompile, or redistribute assets.
• Present LAVIA content as your own.

6. Your content

You control what you enter. When you log a meal, log water, add a measurement, save a reflection, or upload a progress photo, you grant us a limited license to store and process it only to provide the service to you. See our Privacy Policy.

You may not upload content that is unlawful, harmful, sexual, or infringing on someone else's rights.

7. Acceptable use

You agree not to:

• Reverse engineer, decompile, or extract source code.
• Access the app or its services by any means other than the officially published clients.
• Interfere with the operation of LAVIA, or attempt to overload our servers.
• Share your account credentials with others.
• Use LAVIA to violate applicable laws.

We may suspend or terminate accounts that violate these Terms.

8. Availability & changes

We do our best to keep LAVIA available, but we do not guarantee uninterrupted service. We may add, modify, or remove features at any time. If we retire the service, we will give reasonable notice and honour outstanding subscription periods where possible.

9. Third-party services

LAVIA depends on third-party services (Apple, Google, Supabase, RevenueCat, and, where enabled, PostHog, Sentry, AI providers). Their outages or changes can affect LAVIA. Their own terms apply where you interact with them (for example, App Store purchase terms).

10. Intellectual property

The LAVIA name, logo, app, design, code, workout videos, Face Yoga sessions, and recipes are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the app for personal use for as long as you have a valid account.

11. Disclaimer

LAVIA is provided "as is" and "as available". We make no warranty that the service will meet your requirements, be uninterrupted, error-free, or produce any particular fitness, aesthetic, or health outcome.

12. Limitation of liability

To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or 50 USD, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages, including injury caused by your performance of exercises without appropriate medical clearance.

Some jurisdictions do not allow this limitation; in those jurisdictions our liability is limited to the greatest extent permitted.

13. Indemnity

You agree to defend and indemnify us against claims arising from your misuse of the Service or breach of these Terms.

14. Termination

You may stop using LAVIA at any time by uninstalling the app or deleting your account. We may terminate or suspend access if you materially breach these Terms. Sections that by their nature should survive (ownership, disclaimers, liability, dispute resolution) will survive termination.

15. Governing law & disputes

These Terms are governed by the laws of the operator's principal place of business, without regard to conflict-of-laws principles. You and we agree to try to resolve any dispute in good faith through the contact address before turning to courts of competent jurisdiction.

If you reside in the EU/UK, mandatory consumer protections in your jurisdiction still apply.

16. Changes to these Terms

We may update these Terms occasionally. Material changes will be announced in the app. Continued use after 30 days from notice constitutes acceptance.
